How to Spot a Fake or Illegal Vape

How to Spot a Fake or Illagal Vape

A vape duty stamp helps you assess a product, but it is not proof of authenticity on its own. Check the stamp, packaging and seller together. Eligible older stock can still be sold without a stamp until 31 March 2027. No public HMRC consumer stamp checker was identified when this guide was checked.

What a UK Vape Duty Stamp Looks Like

A UK vaping duty stamp is a rectangular security label attached to the outermost retail packaging. HMRC’s published transitional examples are yellow or red. Colour alone does not establish authenticity, and HMRC has not assigned those colours a meaning such as nicotine strength or product type.

The stamp is tamper-evident, opening the package must damage either the packaging or the stamp. A loose label sitting beside the opening does not perform that sealing function.

Two stamp types matter:

  • Transitional stamps: contain physical security features without a scannable code.
  • Digital stamps: add a scannable code for authentication and supply-chain tracing.

The current GOV.UK guidance confirms that only digital stamps may be affixed from 1 January 2027. That is an application deadline, not a statement that every existing transitional-stamped pack becomes illegal that day. Do not use this description to predict the final digital artwork.

The Buyer's Checklist

Use these 6 checks to assess the stamp, the pack and the seller before buying. Each check adds context; none gives a guaranteed verdict by itself.

1. Check the stamp’s position

Look for a duty stamp on the product’s outermost retail packaging where a stamp is required. A photograph of a stamp on a website does not show that the pack delivered to you carries one.

2. Inspect the seal without peeling it

Look for evidence that the stamp has been lifted, transferred or attached over an already opened pack. Torn edges, unexplained adhesive marks and a loose seal are reasons to pause.

Do not peel off the label to test it. A vaping duty stamp cannot be reused once affixed. Ask for an unopened replacement or leave the product unbought if the packaging raises doubts.

3. Compare the stamp and packaging with official information

Compare transitional stamps with HMRC’s published examples rather than an image shared by an unknown seller. Matching the general shape and colour is only an initial visual check.

Read the rest of the pack. Compare the model, nicotine strength and liquid volume with the listing. Ask about missing instructions, inconsistent spelling or a different product name. Packaging differences deserve an explanation, although a difference alone does not prove counterfeiting.

Product rules remain separate from duty stamping. For example, the UK consumer nicotine-liquid limit is 20mg/ml, equivalent to 2%. A stamp does not override that limit. A nicotine product advertised at 5% deserves particular scrutiny.

4. Check who is selling the product

Choose a retailer with a clear business identity, working contact details and an accessible returns policy. Check whether the seller can answer a specific question about the product, rather than simply repeating that it is “100% genuine”.

5. Compare the price and listing

Treat an unusually low price as a reason to ask questions, not as proof of an illegal product. Compare the same model, pack quantity and liquid volume across retailers. For background on the duty and its pricing implications, read our guide to the UK vape tax 2026 price rise.

6. Pause and report unresolved concerns

Leave the product unbought when the explanation does not resolve your concerns. Avoid using a product you already own while you seek clarification about suspected counterfeiting or tampering.

Keep details already available to you, such as the receipt, listing and photographs. Report suspected illicit vaping products through HMRC’s official reporting route. You do not need to prove the offence yourself.

Is a Vape Without a Stamp Illegal?

No, a missing stamp does not automatically make a vape illegal to sell during the current grace period. Eligible stock produced or imported before 1 October 2026 can be sold unstamped until 31 March 2027.

Ask the retailer whether an unstamped product qualifies as older stock. “We do not need stamps yet” is too broad an explanation, because the requirements already apply to liable new stock.

From 1 April 2027, vaping products outside duty suspension must carry a valid stamp. Duty suspension is a controlled business arrangement, not an exception for ordinary shop purchases. The grace period does not excuse other product-rule breaches.

Vaping Products Duty and the stamp scheme began on 1 October 2026. The duty rate is £2.20 per 10ml of vaping liquid, including nicotine-free liquid. Empty hardware should not be confused with products containing taxable vaping liquid.

Why a Brand QR Code Is Not a Duty Stamp

A brand QR code belongs to a manufacturer’s verification or information system. A vaping duty stamp belongs to HMRC’s duty scheme. Scanning one does not check the other.

Reach a manufacturer’s official website independently when checking its verification instructions. Do not treat a professional-looking scan result as a substitute for examining the pack and seller.

What to Do If You Think a Product Is Fake

Report suspected illicit vaping products to HMRC through the GOV.UK reporting service. Local Trading Standards can receive concerns about counterfeit or non-compliant products.

HMRC says not to send supporting material with the initial report. State that you have evidence and follow any later request. You can report without giving personal details. Do not investigate the seller yourself or announce that you are reporting them.

What Changes When the Digital Checker Launches

An official consumer scanning service would add another check when HMRC makes it available. HMRC has said retailers and customers will be able to scan digital stamps “in due course”. No public consumer checker or launch date was identified in the guidance checked for this article.

Business supply-chain scanning is separate from a public buyer-facing service. Follow future GOV.UK stamps instructions instructions when a consumer checker is announced. Keep checking the packaging and seller alongside any scan result.

FAQs About Fake or Illagal Vape

Does a duty stamp prove my vape is genuine?

No. A duty stamp is one part of assessing a vape, rather than a complete authenticity guarantee. Check the seal, product information and seller together. A convincing label does not resolve concerns about altered packaging, a misleading listing or a product that fails other UK requirements.

Can I scan a transitional vape duty stamp?

No. Transitional duty stamps have physical security features without a scannable code. A separate QR code on the box may belong to the manufacturer. Do not confuse that brand code with HMRC’s stamp scheme or assume a transitional stamp is fake simply because it cannot be scanned.

Does a red stamp mean a stronger vape?

No, nicotine-strength meaning has been assigned to red stamps in the HMRC guidance checked for this article. Yellow and red appear in the published transitional examples. Read the nicotine strength on the product label, and check that the pack matches the listing rather than interpreting the stamp’s colour.

Can a genuine vape still be illegal to sell?

Yes. Brand authenticity and legal compliance answer different questions. A genuine product can still fail UK requirements, such as the maximum permitted consumer nicotine-liquid strength.

Should I buy an unstamped vape before April 2027?

Only consider an unstamped vape when the retailer can explain why the stock qualifies for the grace period and the remaining checks raise no concerns. Eligible older stock can be sold until 31 March 2027. An unexplained missing stamp is a reason to pause rather than accept reassurance alone.
